Describe the actual activity
Immigration status and permission for a particular job are separate checks. The foreign-work legislation restricts work without the relevant entitlement and work beyond its scope. Actual duties, work location, service recipient and employer matter. Company registration or a long visa alone does not resolve those questions. For local employment, first check work permission and occupation restrictions.
A specific route is not universal
BOI expressly describes LTR Work-from-Thailand Professionals as remote work for an overseas employer, without a work permit for Thai employment. DTV has a workcation category, but do not extend it automatically to local jobs, selling or every freelance service. For mixed activities, seek DOE or qualified Thai counsel’s clarification before starting. Separately assess the tax source: a foreign payer does not automatically make income foreign-sourced.
Next steps
- List duties, clients and the employer’s country.
- Check the visa and separate work entitlement.
- Check the current restricted-occupation notification.
- Seek written clarification for mixed activities.
